Terms of Service

These Terms of Service ("Terms") govern your use of the Lumi application and related services (the "Service") provided by Umar Raja ("we," "our," or "us", operated by Endpoint Technology LLC). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Lumi is a household management application that allows you to organize and track finances, mortgage and insurance details, home equipment, home improvement projects, medical records, receipts, documents, tasks, grocery lists, meal plans, and calendar events for your household. The Service includes AI-powered features that sort household instructions into app actions and answer questions about your household data.

Lumi is provided as a tool for personal household organization. It is not a substitute for professional financial, medical, legal, or tax advice. You should consult qualified professionals for decisions in those areas.

2. Eligibility

You must be at least 13 years old to create a Lumi account. If you are under 18, you must have the consent of a parent or legal guardian to use the Service. By using Lumi, you represent that you meet these eligibility requirements.

3. Account Registration and Security

To use Lumi, you must create an account with a valid email address and password. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security and confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

4. Subscriptions and Payments

4.1 Subscription Plans

Lumi Plus is offered as an auto-renewing subscription (weekly or annual terms, with an introductory free trial where indicated). Current pricing and available plans are always shown in the app and on the App Store purchase sheet before you confirm any purchase.

4.2 Billing and Auto-Renewal

All subscriptions are billed through Apple's App Store. By subscribing, you acknowledge and agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription will automatically renew at the end of each billing period (weekly or annually) unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current billing period at the rate of your selected plan.
• You can manage and cancel your subscription at any time through your Apple ID Account Settings or the Settings app on your device under Subscriptions.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Price changes may occur, and you will be notified in advance. Continued use after a price change constitutes acceptance.

4.3 Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple through their standard refund process. We do not process refunds directly.

5. Acceptable Use

You agree not to use Lumi to:

• Violate any applicable local, state, national, or international law or regulation
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems, other users' accounts, or data not belonging to you
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application
• Use the Service to store or transmit content that infringes on the intellectual property rights of others
• Abuse, harass, or transmit threatening content through any feature of the Service
• Use automated scripts, bots, or scrapers to access or interact with the Service
• Interfere with or disrupt the integrity or performance of the Service
• Resell, sublicense, or commercially exploit the Service without our written consent

We reserve the right to suspend or terminate your account if you engage in any prohibited conduct.

6. Your Content

You retain full ownership of all data and content you upload or enter into Lumi ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy, legality, and appropriateness of Your Content. We do not monitor, verify, or endorse any content you upload.

When you use Lumi's AI features, Your Content may be processed to turn household instructions into app actions, summaries, and recommendations. The current build keeps Lumi app-scoped and does not call a live AI model unless a provider is explicitly enabled for the Service.

7. Intellectual Property

The Lumi application, including its design, code, features, graphics, and branding, is owned by Umar Raja and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial household management purposes, subject to these Terms.

"Lumi" and associated logos are trademarks of Umar Raja. You may not use our trademarks without prior written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing:

• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• Financial data displayed in Lumi is for informational and organizational purposes only and should not be relied upon as financial advice. Verify all financial information with your financial institution.
• Medical records stored in Lumi are for personal reference only. Lumi is not a medical device and does not provide medical advice, diagnosis, or treatment.
• AI-generated responses may contain inaccuracies. You should verify any information provided by the AI before relying on it.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UMAR RAJA, LUMI, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Umar Raja and Lumi from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

By You: You may stop using Lumi at any time. To cancel your subscription, manage it through your Apple ID Account Settings. To delete your account and all associated data, contact us at support@lumifamily.app or use the account deletion feature in Settings.

By Us: We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate the Service entirely with reasonable notice.

Upon termination, your right to use the Service ceases immediately. Sections 6 (Your Content ownership), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) survive termination.

12. Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. The "Last Updated" date at the top indicates when the Terms were last revised. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Hillsborough County, Florida.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumi regarding your use of the Service, superseding any prior agreements.
